The petitioners intend to contest the election of the Eastern & North East Frontier Railway Co-operative Bank Limited. According to the petitioners, today (29.09.2023) is the last date for filing the nomination papers. The petitioners are allegedly not permitted to contest the election as the petitioners failed to conduct the election within the stipulated time period. The Court is not in a position to decide the issue within such short period of time.

In view of the above, leave is granted to the petitioners to approach the Central Registrar of Cooperative Societies being the respondent no. 2 for remedial measures to be taken. If the petitioners are found eligible, then necessary steps shall be taken in the matter by the aforesaid respondent.

Learned advocate for the petitioners submits that the petitioners will approach the aforesaid respondent by today.

The respondent no. 2 shall take a decision at the earliest but positively by October 6, and communicate the decision to the petitioners immediately thereafter.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
