Rakib (rejected) CRM (NDPS) 1264 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gaighata Police Station case No. 1205 of 2024 dated 27.12.2024 under Sections 22(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that 840 bottles of phensedyl were recovered from the joint possession of the petitioner and another. Although, the evidence has commenced but there is no possibility of the trial concluding in near future, as such the petitioner may be released on bail.
Learned advocate for the State submits that three witnesses have been examined and the prosecution intends to examine six more witnesses and prays for three more months to complete the prosecution evidence.
Having considered the time period prayed on behalf of the State, I direct that if the prosecution evidence is not completed within the next three months, learned trial Court would release the petitioner on bail.
However, at this stage CRM (NDPS) 1264 of 2025 is dismissed.
No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of the resolution of the local bar.
It is reiterated that, in case any of the accused adopts dilatory measures, learned trial Court obviously would not adhere to the directions stated above.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
