Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused. Petitioner is in custody for 4 months 10 days and charge sheet has already been submitted and charges have been framed. However, detention according to the petitioner is unwarranted.

Learned advocate for the State submits that although there are statements against the present petitioner but there is no reflection of any CDR being retrieved or any money transaction between the petitioner and the principal accused. Learned advocate for the NCB submits that thrice notices under section 67 of the NDPS Act were issued but the

petitioner did not respond, as such the authorities were forced to arrest him.

In view of the factual circumstances of the case, I am of the opinion that further detention is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Jahidul Dafader shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 6th Court Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the District of 24 Parganas North without the permission of either the Investigating Officer or the learned Special Court.

Accordingly, CRM (NDPS) 1248 of 2025 is allowed. Report so submitted by the NCB be kept with the record.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
