Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the statement of the principal accused from whom seizure of 24 Kgs. of Ganja were recovered. Petitioner is in custody for 4 months and there is no possibility of the trial concluding very soon, as such on any stringent condition petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that charge sheet has already been submitted and the charges would be framed very soon, as such the prayer for bail be rejected.

Having considered the complicity of the present petitioner I am of the view that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Firoj Gazi @ Firoz Sardar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 8th Court, Barasat North 24 Parganas.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas North without the permission of the learned Special Court. Accordingly, CRM (NDPS) 1253 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
