Learned advocate appearing for the petitioners submits that petitioners along with others were implicated in connection with the instant case while recovery of 31.3 kgs of ganja. Both the petitioners are in custody for six months and although, charge-sheet has been submitted and there is no possibility of the trial commencing or concluding in near future, as such, the petitioners may be released on bail on any stringent conditions. Learned advocate for the State on the other hand opposes the prayer for bail.

Having considered the quantum of recovery, I am of the view that rigors of Section 37 of the NDPS Act are attracted. Accordingly, CRM (NDPS) 1259 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
