Gafar Molla v. State Of West Bengal
D/L 120 25.11.2025 Bpg.
Dismissed C.R.M. (M) 1927 of 2025 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (Corresponding to Section 439 of the Code of Criminal Procedure) filed in connection with Sutahata Police Station Case No.335/23 dated 13.09.2023 under Section 395 of the Indian Penal Code and Sections 25/27 of the Arms Act and charge-sheet submitted under Sections 395/120B of the Indian Penal Code and Sections 25/27 of the Arms Act;
Gaffar Molla
Versus
The State of West Bengal Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha.
...for the petitioner.
Ms. Baisali Basu Ms. Sana Naaz.
...for the State.
Learned advocate appearing for the petitioner submits that the petitioner was taken into custody on or about 10th November, 2023 and since then he is in custody. In the meantime, the petitioner suffered cardiac issues for which he was treated at SSKM Hospital and the same was while he is in custody. It has been submitted that the case has already been committed to the court of sessions and the next date has been fixed for consideration of charges on 19th January, 2026.
Learned advocate for the State, on the other hand, submits that from the petitioner a sum of Rs.50,000/- along with arms were recovered. Petitioner was also seen in the CCTV footage. Be that as it may, since the date for charges have been fixed on 19th January, 2026, I am of the view that, at this stage, it
would not be fit and proper to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner being CRM (M)1927 of 2025 is dismissed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
