A direction to secure expeditious disposal of Title /RK Ct Suit No. 16321 of 2014 pending before the learned Civil Judge (Senior Division), 3rd Court, Howrah, is the ultimate relief sought for in this case.
Mr.
Haradhan Banerejee, learned advocate appearing for the petitioners taking recourse to Section 20C of Specific Relief Act, 1963 submits that in view of latest amendment in the Specific Relief (Amendment) Act, 2018 (18 of 2018) with effect from 1st October, 2018, there has been some time limit prescribed, within which the suit has to be to disposed of. No other point is raised requiring address by this Court.
In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.
Service upon the opposite parties is thus dispensed with.
Accordingly, the application stands disposed of requesting learned Civil Judge (Senior Division), 3rd
Court, Howrah in Title Suit No. 16321 of 2014 to ensure expeditious disposal of the referred suit, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.
Petitioners are, however, given liberty to bring it to the notice of the Court below about the latest amendment taken place, as referred hereinabove with regard to Specific Relief Act, 1963, in presence of the opposite parties.
Petitioners are directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties. With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
