Petitioner's prayer for bail is being renewed on the ground that in spite of several directions by this court to expedite the trial, the State has been negligent and has not proceeded with the trial in spite of several directions by the High Court. An order dated 11th June, 2025 is brought to the notice of this court wherein it appears that the State had submitted that only three witnesses were left to be examined, but after almost seven months having passed since then, the trial still remains incomplete.

2. Today, the learned counsel for the State submits that only two witnesses remain to be examined and they need one more month to complete the trial. It appears that the State is making the same submission on repeated occasions.

Accordingly CRM (M) 2056 of 2025 is disposed of with the direction that the learned Trial court shall take up the trial on the next date fixed before it i.e. on 15th January, 2026 and shall conduct the trial on day-to-day basis without granting any unnecessary adjournment to either sides and make all endeavour to conclude the trial by conducting the same as directed and preferably within January, 2026. The prayer for bail stands rejected at this stage.

The learned Trial court which includes the learned Trial court-in-charge as it is submitted that the concerned court is lying vacant.

Let a copy of this order be sent to the learned District Judge, Barasat for his information.
