Having heard the Learned Counsel for the petitioner and also taking into consideration the objection of the Learned Counsel for the Union of India, I am inclined to allow the prayer for bail of the petitioner on the ground that the rigor of Section 37 of the NDPS Act will not be applicable in this Case.

Furthermore, other co-accused person, who is similarly circumstanced with the petitioner, has been granted bail by another Coordinate Bench.

Thus, the prayer for bail is allowed.

Accordingly, the petitioner, namely Md. Yasir Akhter Ansari shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the learned Chief Judicial
Magistrate, North 24 Parganas at Barasat and on further conditions that the petitioner shall not leave the geographical limit of district of North 24 Parganas without the leave of the learned Trial Court and shall report to the concerned Police Station once in a week until further order.

The petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever.

In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner's bail in accordance with law without further reference to this Court.

The application for bail is, accordingly, allowed. 8.
