1. This application has been filed by the petitioner/husband under Article 227 of the Constitution of India seeking expeditious disposal of the Mat Suit No. 142 of 2016 now pending before the learned Additional District Judge, Fast Track Court No. 3, Barrackpore, District: North 24-Parganas.

2. It is the case of the petitioner that he has filed Matrimonial suit for divorce under Section 27(1) of the Special Marriage Act 1954 in the year 2016 even filing written statement and written objection, the suit is not yet disposed of by the Trial Court.

Therefore, a direction may be passed to dispose of the Matrimonial Suit as expeditiously as possible.

3. Having heard the submission of the learned counsel and on perusal of the order annexed with the application, the Matrimonial suit has not been proceeded since there is due of alimony pendente lite and same has not been paid by the petitioner/husband.

4. It appears the date has been fixed on 07.01.2026 for filing the statement of account by the respondent/wife and hearing of stay application.

5. Considering the above facts and circumstances of this case, learned Judge is requested to dispose of the stay application filed by the respondent/wife after filing statement of account by the opposite party/wife and upon payment of all arrear, the Trial Court shall make all endeavor to conclude the proceeding on the basis of day to day hearing.

6. With the above observation and direction this application is disposed of.

7. There shall be no order as to costs.

8. All parties shall act on server copy of the order downloaded from the official website of this Court.
