Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years and 7 months and till date charges have not been framed and the petitioner is similarly placed as other accused persons who have been granted bail.

Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the post-mortem report, statement under Section 164 Cr.P.C. of one eye witness as well as the injury report.

I find that the petitioner inflicted the fatal blow on the head of the deceased. Having considered the same, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 1999 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
