Report submitted by the learned advocate appearing for the State be kept with the record. Petitioner is aggrieved by the fact that in spite of informing the police authorities on or about June, 2024, no steps were taken. Accordingly, petitioner is aggrieved relating to the police inaction.
State has submitted a report which reflects that an enquiry was conducted, but the accusations of the petitioner could not be substantiated.
Be that as it may, since the petitioner is aggrieved by the inaction of the police authorities for not taking proper steps in accordance with law, I am of the view that if the petitioner, has materials in her custody, she would prefer an application under Section 175(3) of the BNSS, 2023 before the jurisdictional court. Learned court would assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.
With the aforesaid observations, the writ petition being WPA 24618 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
