Upon taking note of the festive season and the loss of business, which the petitioner will suffer in case of disconnection, this Court gives an opportunity to the petitioner to pay up the dues in instalments. Rs.7,00,000/- shall be paid within November 20, 2024 and the remaining dues will be paid in four equal monthly instalments. The Court takes note of the submission made by the learned Advocate for the CESC that, when attempts were made to disconnect, serious obstruction was created by the men and agents of the petitioner. The police authorities also did not assist.

Thus, on account of failure of the petitioner to pay the amount, as directed by this Court, the CESC shall be entitled to disconnect with the assistance of the local police.

Needless to mention, the CESC authority is at liberty to take action in case of failure to pay up the money, as directed above.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
