A non-speaking order, for grant of higher payscale in favour of the writ petitioner who is PostGraduate category teacher with B.Ed, of the Deputy Director of School Education, West Bengal dated July 13, 2023 is under challenge in the instant case.

Mr. Ghosh, learned advocate appearing for the petitioner, has submitted that the Court has passed orders earlier in other writ petitions in the similar circumstances, directing the concerned respondent authority to reconsider the petitioner's case after granting reasonable opportunity of hearing to him, Mr. Ghosh has prayed for similar order in the instant Case.

Mr. Datta has represented the State. Mr. Datta is not in two opinion regarding earlier orders being passed in similar kind of matters by this Court. 4.

Having heard both the learned counsels for the respective parties, the Court is of the considered opinion that there would not be any reason to treat the instant matter differently with the other similar writ petitions.

Hence, let the instant writ petition be disposed of with the directions as follows:

i. The impugned order dated July 13, 2023 of the Deputy Director of School Education, Govt. of West Bengal is set aside being an unreasoned one.

ii. The respondent No.2/Commissioner of School Education, Government of West Bengal is directed to treat the present writ petition as the representation of the writ petitioner and consider her prayer as made therein, after granting him a reasonable opportunity of hearing.

iii. The prayer of the writ petitioner as above may be disposed of by the said respondent No.2 by dint of a reasoned order, within a period of six weeks from the date of communication of copy of the order, along with a copy of the writ petition, before it.

With the above observations and directions, the writ petition being WPA 23826 of 2025 is disposed of.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
