1. The learned counsel for the petitioners has submitted that the petitioners are in custody for more than 1 year 3 months and in spite of submission of the charge sheet, no charge has been framed.

2. Learned counsel for the State has submitted that due to absconsion of the two other accused persons, the charges have not yet been framed. It appears that one of the accused persons has been granted bail on the ground that nothing has been recovered from his possession. However, from the possession of the present petitioners, 43 kgs of ganja have been recovered.

3. Accordingly, I am not inclined to grant bail to the petitioners at this stage.

4. Prayer for bail of the petitioners is rejected. (Apurba Sinha Ray, J.)
