1. Heard learned Advocates for the parties and perused the case diary produced by the State.

Having heard the leaned Counsel for the petitioner and also taking into consideration the objection of the learned Counsel for the State, I find that there is a love relationship between the victim and the principal accused. The present petitioner is allegedly the neighbour of the principal accused. The investigation has already been completed.

In view of the above, I am inclined to allow the prayer for anticipatory bail on condition.

Accordingly, I direct that in the event of arrest the petitioner namely, Tufan Singh, shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of Arresting Officer,

subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The petitioner shall meet the I.O. of this case once in a week until further order and the petitioner shall cooperate with the investigation till completion of investigation with further condition that the petitioner shall not enter the jurisdiction of the jurisdiction where the victim girl resides.

In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned court below shall be entitled to cancel the anticipatory bail without further reference to this Court.

Accordingly, the prayer for anticipatory bail of the petitioner is allowed.
