1. This revisional application has been filed with a prayer for expeditious disposal of the Criminal Misc. Case No. 22 of 2018 initially filed before the learned Chief Judicla Magistrate at Barasat which in turn was subsequently transferred to the learned Judicial Magistrate, 2nd Court, Barasat, North 24 Parganas for disposal.

2. Learned counsel appearing for the petitioner has submitted that the Misc. Case under Section 125 of the Code of Criminal Procedure is pending since 2018.

3. Considering the nature of prayer, I am not inclined to direct the petitioner to serve notice upon the opposite parties who in no manner will get prejudiced. Accordingly, service of notice upon the opposite parties stands dispensed with.

4. I have gone through the records including the copy of the order passed by the learned Trial Court and from thereon, it appears that both the parties to this revisional application are the author of delay in proceeding with the case.

5. After keeping an eye to the settled proposition of law relating to matters involving maintenance, I would like to request the learned

Trial Court to dispose of the matter expeditiously without giving any unnecessary adjournment to either of the parties preferably within six months from the date of communication of this order.

6. With the above observation, the revisional application stands disposed of.

7. Department is directed to communicate this order to the learned Trial Court for necessary compliance.

8. Leave is granted to the petitioner to make necessary correction in the cause title.

9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Bibhas Ranjan De, J.)
