There was a direction by the ld. Jurisdictional court for further investigation.
Subsequent to the further investigation having commenced, documents have been recovered and signatures have been sent to the examiner of questions and documents.
Ld. Advocate for the State has also submitted that two documents/deeds are lying with the Debts Recovery Tribunal, which are required for the purpose of the investigation.
If an application is made by the investigating officer in this case, the Tribunal would give certified copy of the said deeds/documents to the investigating officer of the case. The investigating agency will at the earliest file their report under section 173 of the cr.p.c., if required.
The report in respect of the examiner of questions and documents may be submitted subsequently by way of Supplementary Charge Sheet.
The ld. Trial court on receipt of the report under section 173 of the c r.p.c. will consider the issue relating to cognizance and thereafter proceed with the case as expeditiously as possible.
With the aforesaid observations, CRR 3901 of 2023 is disposed of.
Pending application, if any, is also disposed of. Report so submitted be kept with the record.
