1. Leave is given to the petitioner to incorporate Section 103(1) of the Bharitiya Nayay Sanhita in the cause title of the petition here and now.
2. Heard the submission of both the learned Advocate. On careful perusal of the materials on record and the statement recorded under Section 182 and 183 of the Bharatiya Nyay Sanhita and the content of the FIR it is apparent that the present petitioner is not the principal accused. Considering the role attributable by him coupled with the fact of the period of detention already covered, which is more than one year and that the charge-sheet has been submitted, this Court is inclined to allow the prayer of the petitioner.
3. Accordingly, the prayer for bail of the petitioner is allowed.
4. Accordingly, the petitioner, namely, Sujan Mandal, be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Jangipur, with the
condition that the present accused petitioner shall appear before the learned Trial Court on each and every date of substantive hearing and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.
5. Let the case diary be returned.
