Ajimuddin Sk@Rajan Sk@Ajimadin Sekh v. State Of West Bengal
17.11.2022 Sl. No.3 akd [Rejected] C. R. M. (NDPS) 1317 of 2022 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 04.11.2022 in connection with Palashipara Police Station Case No.316 of 2020 dated 30.10.2020 under Sections 21(c)/29 of the NDPS Act.
And In Re: Ajimuddin Sk. @ Rajan Sk. @ Ajimadin Sekh ... ... Petitioner Mr. Sumanta Das ... ... for the petitioner Mr. Ranadeb Sengupta ... ... for the State It is submitted on behalf of the petitioner that no narcotic substance was recovered from his possession.
Report is placed on record. It appears from the report recovery was made from the courtyard of the ancestral house of the petitioner. In view of the aforesaid incriminating materials showing control and dominion of the petitioner over the place where narcotic substance above commercial quantity was recovered, we are of the opinion this is not a fit case to grant bail to him.
The application for bail is thus rejected.
