By this application, the petitioners seek expeditious disposal of the application under Order 12 Rule 6 of the Code of Civil Procedure filed in connection with Money Suit No.268 of 2017, pending before the learned Civil Judge (Senior Division), 1st Court at Barasat.

Considering the submissions, the Court is of the view that the prayer of the petitioners is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite parties.

The revisional application is disposed of with a direction upon the learned court below to dispose of the application within a period of two months from the date of reopening of the court after the puja vacation. Adequate opportunity shall be granted to the parties to contest the same.

This court has not expressed any opinion on the merits of the application. The learned court shall proceed independently and in accordance with law.

However, this order shall not be construed as an observation on the merits of the application. The petitioners are at liberty to bring this order to the notice of the learned court below upon service of the same along with the revisional application upon the opposite parties, so that the next date can be preponed. The revisional application is accordingly disposed of. There shall be no order as to costs.
