(Through Video Conference) Mr. Rabi Sankar Chattopadhyay Mr. Sayan Chattopadhyay Ms. Payel Shome ... ... for the petitioners The petitioners are aggrieved by the inaction on the part of the Haldia Municipality in taking steps for approval of the building plan which was submitted by them on 23rd October, 2019.

The petitioners submit that they are the lessees in respect of the plot of land which was given to them on lease by the Haldia Dock Complex, Kolkata Port Trust for a period of 30 years with effect from 19th February, 2019 to 18th February, 2049.

None appears on behalf of the Haldia Municipality despite service.

As it appears that the application for approval of the building plan is pending consideration at the end of the Haldia Municipality, no useful purpose will be served by keeping the writ petition pending.

The writ petition being WPA 22158 of 2019 is disposed of by directing the respondent no.2 being the Haldia Municipality to take steps for consideration of the application of the petitioners for approval of the building

plan, strictly in accordance with law, within a period of 3 months from the date of communication of this order. The said respondent shall intimate the petitioners the fate of the plan which was submitted for approval immediately thereafter.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Amrita Sinha, J.)
