Patra Ms. Supriya Dubey Ms. Debalina Chakraborty .......For the SSC Mr. Tulshidas Ray ......For the State Pursuant to the direction given by this court on 09.11.2021 the Commission has filed one report in the form of an affidavit wherefrom it appears that the petitioner got total marks 85.00 whereas the last candidate recommended in Physical Education got 88.30 marks. The petitioner today has submitted that he should qualify under the clause of qualification which speaks about sports/games at least in school/college/ district level in accordance with the National Council for Teacher Education (Recognition norms and procedure) Regulations 2007 notified on 10.12.2007.

The School Service Commission in its report has stated that the petitioner could not produce any sports/games certificate in accordance with the

relevant Rules at the time of verification which was also one of the essential requirements for consideration. The Commission has also raised serious objection with the photo copy attached to the writ application relating to a sport certificate stating that the certificate neither contains any affiliation number nor any logo for the concerned association. Further the said certificate is neither self-attested as required and has several printing errors as would appear from the words "affiliation", "certificate" and "position" and also has an incomplete address which raised serious doubts with regard to genuineness of the said certificate.

The said certificate has been annexed by the writ petitioner at page 66. I have seen and checked the spellings as has been referred in the said affidavit of the Commission and the objections of the Commission are all correct. The Kabaddi Association which has issued the certificate also does not have any address or any other registration number. In my view the School Service Commission has not done any wrong in not considering this certificate. The petitioner has failed to show before me today that this certificate comes within the essential qualification of National Council for Teacher Education (Recognition norms and procedure) Regulations 2007 notified on 10.12.2007.

After hearing the parties and after considering the pleadings and the documents annexed thereto as aforesaid, I do not find any merit in this writ application and the same is dismissed without any cost.
