Petitioner renews the prayer for bail.

Learned Advocate appearing for the petitioner submits that, out of 24 prosecution witnesses only 11 were examined. None of the prosecution witnesses implicate the petitioner. 4.

Learned Advocate appearing for the State submits that, a person was murdered inside a lorry. Finger prints of the petitioner inside the lorry were found.

Materials on record implicate the petitioner in murder. 6.

An eye-witness who recorded statement under Section 164 of the Code of Criminal Procedure implicating the petitioner, however, turned hostile at the trial.

Nonetheless the forensic evidences are still available which may be adduced at the trial.

At this stage, it would be presumptuous to arrive at a finding that the petitioner is not implicated in the murder. 9.

In such circumstances, we are not inclined to grant bail to the petitioner.

10. Accordingly, the prayer for bail of the petitioner is rejected.

11. CRM (DB) 3403 of 2024 is dismissed.
