The State of West Bengal Mr. Prabir Majumder Ms. Anindita Kundu ...for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the Sessions Trial no. 02(01) of 2024 pertaining to Sessions case no. 12(07) of 2023, presently pending before the learned Additional District & Sessions Judge, Ranaghat, Nadia.

Being aggrieved by the aforesaid delayed proceeding, learned counsel for the petitioner submits that the FIR was lodged on 1st December, 2022 and thereafter, the Investigating Officer submitted charge-sheet against the petitioner on 31st December, 2022. Learned court below framed charge on 7.12.2023 and out of 14 charge-sheeted witnesses, the prosecution has already examined 13 witnesses but last three dates are being fixed by the court below for examination of the Investigating Officer. Due to such abnormal delay in disposal of the case, the petitioner is suffering a lot and recently the authority has declined to select him for the post of a Government job due to pendency of the present application. He therefore prays for a direction upon the court below for expeditious disposal of the aforesaid proceeding.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with.

In view of the aforesaid facts and circumstances of this case, it appears that the prayer made by the petitioner is justified, the instant application being CRR 4518 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour to conclude the trial preferably within a period of three months from the next date of hearing. This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
