Pratima Das v. State Of West Bengal
26.11.2025
IN THE HIGH COURT AT CALCUTTA
Item No.127 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.
Rejected C.R.M. (M) 2046 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Nandakumar Police Station Case No. 202 of dated 21.04.2025 under Sections 103(2)/109/118(2)/126(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 wherein charge-sheet under Sections 103(1)/109/118(2)/126(2)/351(2)/61(2) of the Bharatiya Nyaya Sanhita, 2023 (G.R. Case No. 1133 of 2025). And In Re : Pratima Das ... Petitioner.
Mr. Navanil Das, Mr. Subhrajit Dey ... For the Petitioner.
Mr. Saibal Bapuli, APP, Mr. Debanshu Ghorai ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 172 days; she is innocent of the charges and has been falsely implicated in connection with the instant case. Further it has been submitted that prosecution has relied upon 14 charge-sheeted witnesses in order to prove its case and as such, there is no scope for the trial to be completed in near future.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the case is yet to be committed to the court of sessions. Having considered the gravity of the offence, I am not inclined to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected.
The application for bail, being CRM (M) 2046 of 2025, is, thus, dismissed.
