Heard learned lawyers for the parties.

We have considered the materials on record. Petitioner is in custody for more than one year. 2.65 kgs of opium and 400 grams of heroin including equipments for manufacturing narcotics were recovered. Petitioner was present at the place of recovery. Bail prayer of co-accused has been turned down. Trial is in progress.

Under such circumstances and in view of the statutory restrictions under section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

4. Accordingly, prayer for bail is rejected.

5. Trial court is requested to expedite the trial and conclude the same at an early date.

6. Parties shall communicate this order to trial court for necessary compliance.
