Learned advocate appearing for the petitioner submits that petitioner is in custody for one and half years on accusations of recovery of 105 grams of MDMA from the petitioner and two others. Charge-sheet has already been submitted and charges have been framed. But till date witness action has not started.

Learned advocate for the State submits that the State would rely upon 12 witnesses in order to prove its case. Having considered the quantum of seizure from the present petitioner, I am of the view that rigors of Section 37 of the NDPS Act are attracted.

Accordingly, CRM (NDPS) 1260 of 2025 is dismissed.
