1. An application has been filed by the Port Trust seeking recalling of the ex parte order dated 16th October, 2023. It has been submitted by the applicant that the order was passed without disclosing proper facts and figures. On account of miscommunication, the Port Trust remained unrepresented on the day the matter was taken up for consideration.

2. The urgency in filing the present recalling application is recorded in paragraph 9 of the application.

3. I am of the opinion that the application for recalling may be taken up for consideration by the regular Bench.

4. List on 16th November, 2023 before the regular Bench subject to the convenience of the Court.
