Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 5 months and presently the court is vacant although the examination-in-chief of the victim girl is in progress but the cross-examination has not taken place. Learned advocate for the State has produced the case diary.

I have perused the materials appearing therein. On an assessment of the same, I am of the view that at the stage when the cross-examination is yet to commence, it would not be fit and proper to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is rejected at this stage.

Petitioner will renew his prayer for bail after the crossexamination of the victim girl is over. Learned in-charge court of the special court is directed to conclude the cross-examination within a period of 45 days from the date of communication of this order. Accordingly, CRM (M)1949 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
