Learned advocate for the petitioner submits that the petitioner is in custody since 9th May, 2025 and the allegation against him even if it is taken to be true, prima facie, according to the learned advocate, no culpability is established. Learned advocate for the petitioner prays for bail with any stringent conditions.

Mr. Sur, learned advocate appearing for the State has produced the case diary including statements of witnesses who claim to have partially seen the incident.

Be that as it may, I have taken into account the overall circumstances of the case and is of the opinion that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner namely, Chinmoy Chowdhury @ Totan shall be released on bail upon furnishing bond

of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Ranaghat.

If on bail, the petitioner shall for the next three months once in a week attend Dhantala Police Station. In case the petitioner intends to go outside the jurisdiction of Ranaghat, petitioner will seek the permission of the learned ACJM, Ranaghat. If there are violations of the conditions as laid above, the learned Magistrate or the learned trial court in seisin of the instant case would be entitled to cancel the bail of the petitioner without further reference to this Court.

Accordingly, CRM (M) 1973 of 2025 is allowed. Case diary be returned to the learned advocate appearing for the State.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
