Learned advocate appearing for the petitioner submits that the prosecution case accuses the petitioner along with others for illegal possession of 7500 bottles of Phensedyl. The present petitioner is in custody for 1 year 10 months and only one witness, out of the proposed 11 witnesses, has been examined by the prosecution. Petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that huge volume of contraband has been recovered. It has also been submitted that the petitioner is thickly connected with the alleged offence and release of the petitioner would jeopardize the trial.

I have taken into account the submissions of the learned advocates and I am of the view that the petitioner has failed to overcome the rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. State is directed to conclude the examination of the seizure list witnesses preferably within a period of three months from the next date so fixed.

Petitioner would be at liberty to renew his prayer for bail after the examination of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1283 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
