Considering the incriminating materials available in the case diary including the seizure list showing recovery of alleged contraband from the room of the petitioner in their house, which was in the name of the petitioner's father and the other incriminating materials available in the case diary and in view of the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
