The Sub-Inspector of Schools, Bagnan East Circle of Howrah District Primary School Council, the respondent no.5 herein, in compliance with the direction of this Court dated December 9, 2024 had calculated the amount required to be refunded by the petitioner to get the benefit of family pension and had communicated the said calculation to the District Inspector of Schools (Primary Education), Howrah, the respondent no.4 herein.

The said respondent, in turn, had forwarded the said calculation to the petitioner with a request to refund the said calculated amount to the proper head of account. In pursuance thereof, the petitioner, under T.R. Form No.7, has deposited the said amount in the said account. Mr. Jana, learned advocate for the petitioner files copy of the said communication of the respondent no.4 and the said T.R. Form No. 7; let it be kept with the record.

In view of the deposit of the said amount, the respondent no.4 is directed to prepare the pension papers of the petitioner within two weeks from date of communication of this order and shall forward the same to the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, the respondent no.3 herein; the said respondent within a period of three weeks from the date of receipt of the said pension papers,

shall take forward steps for issuance of Pension Payment Order in favour of the petitioner in accordance with law. It is needless to mention that the arrear pension of the deceased teacher shall be calculated from the date following the date of death.

WPA 24785 of 2024 is disposed of with the above terms without any order as to costs.
