C.R.M (SB) 201 of 2023 In Re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dhantala Police Station Case No. 411 of 2023 dated 6th June, 2023 under Sections 341/354B/506/34 of the Indian Penal Code and Sections 8/12 of the Protection of Children from Sexual Offences Act, 2012. And In Re: Ranjit Biswas @ Bapi Mr. Prabir Majumder Mr. Snehansu Majumder - For the petitioner Mr. Abhra Mukherjee Mr. Goutam Banerjee - For the State Mr. Prabir Majumder, learned advocate appearing for the petitioner submits that the petitioner is in custody for 126 day and charge-sheet has already been submitted in connection with the instant case, as such no further detention is warranted.

Mr. Abhra Mukherjee, learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner being a neighbour has committed such offence which requires further detention in custody.

I have considered the submission advanced by the learned advocate appearing for the petitioner as well as learned advocate appearing for the State. On appreciation of

the period of detention and that the petitioner was not absconding, I am inclined to release the petitioner on bail. Accordingly, the petitioner shall furnish a bond of Rs.10,000 (Rupees Ten thousand only) with two sureties of like amount each, one of whom must be local subject to the satisfaction of the learned Judge, Special Court, Ranaghat, Nadia/learned ACJM, Ranaghat, Nadia.

If on bail, the petitioner shall stay outside the jurisdiction of Dhantala police station and inform the particulars to the Investigating Officer/ the Inspector-incharge/ Officer-in-charge of Dhantala Police Station regarding his place of residence. The petitioner shall not enter the jurisdiction of Dhantala Police Station except for the purposes of attending the investigating officer once in a fortnight till further order of this Court. The Investigating Officer or the person accepting the acknowledgement will submit a report once in a month regarding the attendance to the learned Special Court.

Accordingly, CRM(SB) 201 of 2023 is allowed.

All concerned parties shall act in terms of the copy of the order downloaded from the offcial website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. (Tirthankar Ghosh, J.)
