Rajit Yadav v. State Of West Bengal
17.12.2025
IN THE HIGH COURT AT CALCUTTA
Item No. M/L.622 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.
Rejected C.R.M. (NDPS) 1282 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with STF HQ Police Station Case No. 03 of 2025 dated 26.06.2025 under Sections 21(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
And In Re : Rajit Yadav ... Petitioner.
Mr. Debasis Kar ... For the Petitioner.
Mr. Antarikhya Basu, Ms. Afreen Begum ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is a helper who has been falsely implicated in connection with the instant case on the accusation of recovery of 5000 bottles of Phensedyl and is in custody since 26.06.2025. Petitioner prays for bail on any stringent condition.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are CDRs as well as money trail which emerges from the complicity of the petitioner in connection with the instant case.
Having considered the materials available in the case records, I am of the view that the petitioner has failed to
overcome the rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 1282 of 2025, is, thus, dismissed.
