The report filed by the Inspector-in-Charge, Bhaktinagar Police Station, Siliguri Police Commissionerate dated 16.10.2023 stated that the administrative notice to have been served upon the petitioner. Let the said report be kept on record.

Despite service of notice, none appeared before the Court.

The report submitted by the leaned advocate for the State with regard to the status of G.R. Case No. 3120/10 arising out of Bhaktinagar Police Station Case No. 902/10 dated 23.08.2010 under Sections 498A/494 of the Indian Penal Code is at the stage of recording of evidence. The cognizance was taken by the learned Magistrate on 09.04.2012 charge had already been framed and date had been fixed for recording of evidence.

The petition stated a matrimonial dispute to have been existed between the parties. The petitioners get reasonable

opportunity to defend themselves before the learned trial court and agitate their grievance therein.

Considerable period has been lapsed and the petitioners did not appear before the Court.

Under such circumstances, the instant revisional application is disposed of with liberty to the petitioners to agitate the relevant issues before the learned trial court. Copy of the order be sent to the trial court for immediate compliance.
