Learned advocate for the petitioner and the learned advocate for the State are present.

Perused the materials in the case diary.

The petitioner in the instant case is in custody for a period of one year and six months and the trial is yet to be completed. Learned advocate for the petitioner draws attention of this Court to the order dated 05.06.2025 passed in CRM (NDPS) 643 of 2025 wherein it was observed that the Trial Court shall make endeavour to complete the trial

within a period of four months and in the event, the said trial is not completed within a period of four months, the petitioner will be at liberty to pray for bail before the learned Trial Court.

It appears that the period of the said four months have passed and the next date is fixed on 27.10.2025 and about seven more witnesses are to be examined which may take some time.

Considering the period of detention and the order passed on 05.06.2025, this Court is of the view that in the interest of justice the petitioner should be released on bail. 7.

Thus, I allow the instant prayer for bail of the petitioner. 8.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24 Parganas subject to the conditions that he shall furnish his mobile number to the Officer-in-Charge of the concerned Police Station and shall also meet the Officer-in-Charge of the concerned Police Station once in a week and on further condition that he shall be present on every date fixed before the learned Trial Court and shall not leave the jurisdiction of the Court without the leave of the Trial Court. 9.

In the event, the petitioner fails to comply with any of the above conditions, the learned Trial Court will be at liberty to cancel the bail without any further reference to this Court.

10. CRM (NDPS) 1290 of 2025 is accordingly disposed of.

11. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
