Ms. Roy, learned advocate for the opposite party submits that the opposite party is unable to be present in court owing to his illness and submitted medical documents to that effect. His personal appearance be dispensed with. Let the medical report be kept on record.

The learned advocate for the petitioner submits that the dispute between the parties have been resolved on the basis of a decree of divorce on mutual consent passed by the learned Additional District Judge, 3rd Court, Alipore on 3rd January, 2018 in MAT Suit No. 5 of 2009. The learned advocate for the petitioner further submits a copy of the aforesaid order. Let the same be kept on record. The learned advocate for the petitioner further submits a written instruction on behalf of the petitioner stating that she does

not want to proceed with the case. Let the said written instruction be kept on record.

Under the facts and circumstances, the instant criminal revisional application being CRR 3857 of 2011 is dismissed for non prosecution.

Copy of the order as well as lower court record be sent to the learned trial court for compliance.
