Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and there has been no recovery from his possession. Petitioner undertakes that he would abide by the conditions so imposed in case he is granted bail. Learned advocate for the State submits that the petitioner has been evading the process of law for a considerable period of time and although there has been recovery but because of absconsion of the petitioner there has been no recovery. Learned advocate submits that the cause of delay in the trial is because of the present petitioner.

I have taken into account the period of detention of the present petitioner and the background of the case. Having regard to the period of detention of the petitioner,

I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Lalan Naskar @ Nazibul shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Baruipur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court. Petitioner shall not leave the jurisdiction of the district of 24 Parganas (South) without prior permission of the learned court and the petitioner shall also make his contact number available to Officer-in-Charge/ Inspector-in-Charge of Narendrapur Police Station. Accordingly, CRM (M) 2025 of 2025 is allowed. Report so submitted be kept with the record.
