1. Heard learned Advocates for the parties and perused the case diary produced by the State.

Having heard the learned Counsel for the petitioners and also taking into consideration the objection of the learned Counsel for the State, I find that the present petitioner are not the principal accused. The victim girl has been recovered. The present petitioners are aged about 58 years and 53 years respectively. The statement of the victim girl has not been attempted to be recorded by the Judicial Magistrate at the instance of the Investigating Officer. It is alleged that there is a love relationship between the principal accused and the victim.

However, considering all the aspects of the matters, I am inclined to allow the prayer for anticipatory bail on condition.

Accordingly, I direct that in the event of arrest the petitioners namely, Sahan Ali Sekh and Arjina Bibi Sekh @ Putul, shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of Arresting Officer, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The petitioners shall cooperate with the investigation till completion of investigation. 5.
In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned court below shall be entitled to cancel the anticipatory bail without further reference to this Court.

Accordingly, the prayer for anticipatory bail of the petitioners is allowed.
