Learned advocates appearing for the respective parties submit that the dispute between the parties in relation to the arbitral award dated 23rd March 1999 and the subsequent Title Execution case no. 12505 of 2012 has since been settled. A copy of the email communication dated 7th January 2025 instructing the petitioner's advocate to withdraw the instant revisional application as placed before this Court, is retained with the record.

Having regard thereto and on the prayer of the learned advocates appearing for the parties, the deposit made by the petitioner/judgment debtor thereby securing an amount of USD 1,73,256.88 $ by way of a demand draft in the name of the decree holder with the Learned Registrar General of this Court, which was directed to be retained in his/her safe custody, be returned to the petitioner on the undertaking to be filed by the petitioner with the learned Registrar General that the same shall be deposited with the Learned Civil Judge (Senior Division), 8th Court at Alipore within a period of 7 days from the date of receipt of such deposit.

With the above observations and direction, C.O. 3526 of 2024 is accordingly disposed of.
