1. Chemical report is placed on record.

2. Chemical report shows presence of heroin in the sample.

3. Statement of witness and contemporaneous document i.e. seizure memorandum show recovery of narcotics above commercial quantity i.e. 285 grms of heroin from the petitioner.

4. In view of the aforesaid facts and statutory restrictions under section 37 of the NDPS Act we are not inclined to grant bail to the petitioner.

5. Accordingly, prayer for bail is rejected.
