The subject-matter of this revisional application relates to continuance of Amherst Street Police Station Case No. 192 dated 27.07.2015. Record reflects that charge-sheet was submitted in the year 2023.

Mr. Datta, learned advocate appearing for the petitioner draws the attention of the Court to the relevant part of the charge-sheet wherein it has been averred that the documents from the bank could not be collected as the accounts were dormant. In fact, the formal part of the charge-sheet is also not clear as to which documents were seized by the investigating agency in course of the investigation. However, list of the witnesses reflects that the Bank Manager has been made as a witness. The documents under Section 207 of the Code of Criminal Procedure are yet to be supplied to the petitioner. The petitioner as such is granted liberty to approach this Court on receipt of the documents under Section 207 of the Code of Criminal Procedure. The petitioner will also be at liberty to approach the trial court. In case the petitioner is advised to pray for discharge by invoking the provisions in the nature of Section 239/227 of the Code of Criminal Procedure on receipt of the documents, the petitioner will also be at liberty to take out such application

before the learned Special Court. At this stage, the revisional application is premature.

With the aforesaid observations, the revisional application being CRR 3918 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
