1. Affidavit-of-service as filed today on behalf of the writ petitioner is taken on record.

2. At the time of hearing learned advocate appearing on behalf of the writ petitioner at the very outset draws attention of this court to the internal page No.6 of the order dated 15th May, 2025, as passed by this court in WPA 24881 of 2024.

It is submitted by Mr. Nayak, learned advocate appearing on behalf of the writ petitioner that by the said order dated 15th May, 2025, the Respondent No.3 who is alleged contemnor herein was directed to carry out mutation in respect of the property in question in the name of the writ petitioner without insisting upon any payment of fees in terms of the notification dated June 22, 2012, with a further direction that such exercise is

to be completed within 30 working days from the date of communication of the server copy of the order upon the alleged contemnor.

4. In his next fold of submission Mr. Nayak further contended that in page-83 of the contempt application it would reveal that the said order dated 15th May, 2025, was communicated to the alleged contemnor who received the same on 23rd May, 2025. It is thus submitted by Mr. Nayak that for deliberate violation on the part of the alleged contemnor a Rule of Contempt may be issued against him.

5. Mr. Singha, learned advocate appearing on behalf of the alleged contemnor, submits upon instruction that he has received a communication in electronic mode from the Deputy Secretary, U.D.M.A., Government of West Bengal that Ms.

Sudeshna Mitra was asked to join in the post of Land Manager, OSD & Ex-Officio Secretary, U.D.M.A., with immediate effect.

6. On being asked by this court Mr. Singha could not explain as to what prevented Mr. Rajib Mondal, the alleged contemnor to carry out the order of this court as passed on 15th May, 2025, as has been communicated on 23rd May, 2025.

7. In view of absence of any explanation on the part of the alleged contemnor, Mr. Rajib Mondal, let a Rule of Contempt be issued against Rajib Mondal, the contemnor, forthwith, which is returnable on May 8, 2026, on which day the instant matter will be listed under the same heading.

8. Liberty is given to the learned advocate-on-record to insert the name of the proposed new incumbent Ms. Sudeshna Mitra as alleged Contemnor No.2 by making necessary insertion in the cause title of the instant contempt application, preferably in course of the day in court.

9. Learned advocate for the writ petitioner is hereby requested to communicate the server copy of this order as well as a server copy of the order dated The Rule is drawn in the separate sheet.
