Sammani Ghosh & Anr.

In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

The revisional application was preferred challenging the order dated 14.05.2012 passed by the learned Judicial Magistrate, Lalbagh, Murshidabad in MR Case No. 616 of 2010. The said order, which was passed by the Learned Magistrate, was in an interim maintenance application wherein the Learned Magistrate on the basis of materials appearing, initially granted Rs. 1,000/- each to the two minor children aggregating to a sum of Rs. 2,000/-. Having regard to the fact that the said award was passed by way of an interim measure during the pendency of the main application under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for at this belated stage.

Accordingly, CRR 3256 of 2012 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
