Halim Kaji v. State Of West Bengal & ANR
C.R.R. No.3257 of 2012 (Via Video Conference) D/L 40.
September 22, 2021 Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.
Halim Kaji
Versus
The State of West Bengal and Anr.
Mr. Arijit Ganguly, Mr. Saryati Datta.
...for the State.
As none appears for the petitioner or for the State, Mr. Saryati Datta, learned advocate, is directed to appear and represent on behalf of the State. His appointment may be regularised by the concerned authorities.
The revisional application was preferred challenging the proceedings being G.R. Case No.869 of 1995. The said case arose out of Ramnagar Police Station Case No.132 of 1995 under Section 363/366 of the Indian Penal Code.
Records of the revisional application reflect that there was no interim order restraining the proceedings before the learned trial court.
Having regard to the fact that the incident is of 1995 and today we are in the year 2021 and no information has been furnished before this Court regarding the present stage of the proceedings, I am of the view that no interference is called for at this belated stage.
Accordingly, CRR 3257 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
