Learned advocate appearing for the petitioner submits that the petitioner is in custody for nine months and the subject-matter of the case relates to recovery of about 452 grams of Yaba Tablets. There are 18 witnesses on whom the prosecution has relied upon. However, there is no possibility of the trial concluding in near future. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the seizure list.

In view of the quantum of contraband seized, I am of the opinion that the petitioner has failed to overcome the

rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected.

Learned Trial Court is directed to expedite the process of consideration of charges and give priority to the examination of the seizure list witnesses. The said witnesses be examined by 31.03.2026.

Petitioner would be at liberty to renew his prayer for bail after the seizure list witnesses have been examined. The application for bail, being CRM (NDPS) 1296 of 2025, is, thus, disposed of.
