Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case for alleged recovery of 271 grams of heroin and is in custody for more than 1 year 4 months, as such, on any stringent conditions, the petitioner may be released on bail. Learned advocate for the State, on the other hand, submits that witness action has commenced and the evidence of P.W.2 is in progress. Further, next date has been fixed on 13th January, 2026.

Having regard to the quantum of seizure, I am of the view that rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner in CRM(NDPS) 1291 of 2025 is dismissed.

Petitioner, however, would be at liberty to renew his prayer for bail after the examination of seizure list witnesses are over.

State is directed to ensure that within a period of 60 days from the next date so fixed before the learned trial court, the examination of the seizure list witnesses be completed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
