(M) 2050 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Basanti Police Station Case No. 302 of 2020 dated 31.05.2020 under Sections 363/365/376(3)/376DA of the Indian Penal Code read with Section 6 of the Protection of Children from Sexual Offences Act, 2012.

Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as other accused persons who have been granted bail and petitioner is in custody for 5 years 6 months. Only 6 witnesses, till date, have been examined, out of 26 witnesses cited by the prosecution.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

I have taken into account the earlier stand of the State on 25.07.2025 wherein the State submitted that within 6 to 7 months, they would conclude the evidence of seven witnesses. Consequently, a co-ordinate Bench in CRM (M) 600 of 2025 was pleased to grant time thereby rejecting the application for bail.

There has been no improvement since the earlier bail prayer has been rejected. As such, having regard to the fact

that in five and a half years, only six witnesses have been examined, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Alamgir Laskar shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the POCSO Act-cum-Additional District Judge, 2nd Court, Alipore, South 24-Parganas.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of South 24-Parganas without prior permission of the learned Special Court.

Additionally, the petitioner shall not enter into the jurisdiction of Basanti Police Station without prior permission of the Inspector-in-Charge of Basanti Police Station.

The application for bail, being CRM (M) 2050 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
